Copyright Forms

The U.S. Copyright Office website provides all the necessary information, instructions and forms to properly copyright your songs. Form PA is the basic form to copyright your songs, whether it be in an “unpublished” or “published” form. (“Unpublished” generally means that the song has not been released and distributed for sale to the public).

Use Form PA for registration of published or unpublished works of the performing arts. This class includes works prepared for the purpose of being “performed” directly before an audience or indirectly “by means of any device or process.” Works of the performing arts include: (1) musical works, including any accompanying words; (2) dramatic works, including any accompanying music; (3) pantomimes and choreographic works; and (4) motion pictures and other audiovisual works.

Use Form SR for registration of published or unpublished sound recordings. Form SR should be used when the copyright claim is limited to the sound recording itself, and it may also be used where the same copyright claimant is seeking simultaneous registration of the underlying musical, dramatic, or literary work embodied in the phonorecord. With one exception, “sound recordings” are works that result from the fixation of a series of musical, spoken, or other sounds. The exception is for the audio portions of audiovisual works, such as a motion picture soundtrack or an audio cassette accompanying a filmstrip. These are considered a part of the audiovisual work as a whole.

What is music publishing?

In short, music publishing is the business of making sure that music makers get money for the music they create. The business began well over a century ago, when printed sheet music was a huge market in the music industry, hence the term “publishing.”

Today, music publishers help artists license their music for all sorts of usage. Publishers can help make sure any musical work is properly registered and royalties are properly collected. They can advocate on behalf of their songwriter clients if there are conflicts or issues, and they can even try to find great opportunities for their songwriters’ works (getting a song you write recorded by a major artist, for example). Remember that music publishers aren’t record labels, though some of their practices can certainly overlap. Before signing up with any music publishing company (or record label, for that matter), make sure you understand clearly what they will and will not do on your behalf. Also, remember that music publishing isn’t just for major acts. Independent artists of all genres can gain income, visibility, and opportunities from working with music publishers. When it comes to publishing your music, make sure you’re working with reputable folks who are looking out for your best interest, not just trying to make a buck off of your work. It’s easy to fall into the trap of too-good-to-be-true deals in the music industry. Remember that if a company promises you something that sounds too good to be true, it probably is.
